NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING.
The contest (the "Contest") entry period opens on July 1, 2014, at 12:00:01 am/EST and will close on December 31, 2014, at 11:59:59 pm/EST (the "Contest Entry Period").
1. SPONSOR
The Contest is sponsored by Rémy Cointreau USA, Inc., with an address at 1290 Avenue of the Americas, New York, NY 10104 (the "Sponsor").
2. ELIGIBILITY
The Contest is open to legal residents of California who are twenty-one (21) years of age or older as of July 1, 2014. The Contest is subject to all applicable federal, state, and local laws and regulations, and is void outside the United States and wherever prohibited by law.
Employees, officers, and directors of the Sponsor, its parent companies, divisions, subsidiaries, and affiliates, and the agents and advertising and promotion agencies of each of the foregoing, distributors and retailers, and any other entity that develops, produces, or distributes materials for or related to this Contest, and the immediate family members or households (whether related or not) of any of the above are not eligible to participate or win.
3. HOW TO ENTER
Entrants may enter the Contest online at www.remycelebrasian.com. Entrants may enter the Contest by completing an entry form, providing their first name, last name, mailing address, email address, telephone number, confirming that they are of legal age, and uploading an original photo from a banquet or party Entrant has hosted or attended. Each banquet photo submission must include a description listing the banquet name and the banquet date. Entrants are limited to submitting one (1) photo per banquet. Entrants may share their photo with friends and family using the "Share" feature located on www.remycelebrasian.com. Entrants represent that they have read these Official Rules and the Terms and Conditions on www.remycelebrasian.com and agree to be bound by them and represent that they are of legal age as of July 1, 2014.
4. SELECTION AND NOTIFICATION OF WINNERS
Three (3) different Entrants with the most votes on their submitted eligible photo by December 31, 2014 shall be considered the three (3) presumptive winners of the Contest. Odds of winning the Contest are dependent on the total number of eligible entries received.
The presumptive winners will be notified by e-mail or phone on or about February 1, 2015. The presumptive winners will be required to respond to the winner notification by e-mail, mail, or phone within four (4) calendar days and, in such response, must provide his/her full name, residential mailing address, daytime telephone number, date of birth, and social security number to receive a prize. The presumptive winners will also be required to sign and return within four (4) days of receipt of winner notification an affidavit of eligibility and winner liability/ publicity release before receiving a prize. The failure to respond timely and completely to the winner notification may result in forfeiture of the prize and the Sponsor, in its sole discretion, may select an alternative winner. If an e-mail notification is returned as undeliverable, the Sponsor will attempt to re-send that e-mail three (3) times. If a potential winner does not respond within four (4) calendar days of the transmission of the final e-mail notification, or should the e-mail, after three (3) attempts, be returned as undeliverable, an alternative winner will be selected.
5. PRIZES
There will be a total of three (3) winners.
The 1st Place Prize winner will receive:
• Private Party at an on-premise California licensed location (to be chosen by Sponsor) within fifty (50) miles of the winner’s California household listed on winner’s affidavit of eligibility.
• Private Party will be valued at Five Thousand Dollars (USD $5,000).
• Details of the Private Party shall be determined by the Sponsor in its sole discretion.
The 2nd Place Prize winner will receive:
• Private Party at an on-premise California licensed location (to be chosen by Sponsor) within fifty (50) miles of the winner’s California household listed on winner’s affidavit of eligibility.
• Private Party will be valued at Three Thousand Dollars (USD $3,000).
• Details of the Private Party shall be determined by the Sponsor in its sole discretion.
The 3rd Place Prize winner will receive:
• Private Party at an on-premise California licensed location (to be chosen by Sponsor) within fifty (50) miles of the winner’s California household listed on winner’s affidavit of eligibility.
• Private Party will be valued at One Thousand Five Hundred Dollars (USD $1,500).
• Details of the Private Party shall be determined by the Sponsor in its sole discretion.
The approximate cumulative retail value of all prizes is Nine Thousand Five Hundred Dollars (USD $9,500). In no event will the cumulative retail value exceed Nine Thousand Five Hundred Dollars ($9,500). No transfer or substitution of the prize by the winner shall be allowed. The prize may not be redeemed for cash, and there is no cash value. The prize is non-changeable once redeemed. The prize cannot be used in conjunction or combined with any other competition or offer. The Sponsor reserves the right to substitute the prize and/or any portion thereof for one of equal or greater value for any reason at its sole discretion.
Sponsor reserves the right to cancel this Contest or modify the prizes or Official Rules with immediate effect at any time prior to the closing date of the Contest, by advertising that fact on www.remycelebrasian.com , or by disseminating such information via email.
6. CONDITIONS
Photo Submission Requirements
Photo Entry Guidelines:
• Photo must be from a banquet or party that Entrant either hosted or attended;
• Entrant may submit one (1) photo from a festivity;
• Photo submission must include a description listing banquet name and banquet date;
• Must be FCC acceptable, including no use of indecent or obscene material or language;
• Content should not infringe or violate any copyright, patent, trademark, trade secret, right of publicity, or other intellectual property, proprietary, or contractual right of a third party;
• Entrant must submit an original photo; Infringing photo shall not be accepted as an eligible entry in the Contest;
• No defamatory or libelous material or material which discloses private or personal matters concerning any person, without such person’s consent;
• No content or material that is illegal, contains nudity or is sexually explicit, or by law, obscene, profane or pornographic;
• No misrepresentation or disparaging remarks about Sponsor or its products, or other people, products or companies;
• No content which implies or portrays graphic violence, excessive use of alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), or any activities that may appear unsafe or dangerous;
• No content which is abusive or harassing toward any individual or group of individuals regarding race, sex, religion, creed, national origin, age, disability, gender identity or expression, sexual orientation or any legally protected classification. Specifically this includes, but is not limited to, epithets or slurs, threats, intimidations, or hostile acts;
• No content communicating messages inconsistent with the positive goodwill to which Sponsor wishes to associate;
• Must be socially acceptable and in good taste, as determined by Sponsor in its sole discretion;
• Cannot depict, and cannot itself, be in violation of any law;
• Cannot contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, without permission;
• Sponsor reserves the right to delete any submission they deem not in agreement with these Official Rules.
• All entries and the information contained in such entries will become the Sponsor’s property and will not be acknowledged or returned.
By participating, Entrants agree to be bound by these Official Rules and the decisions of the judges, which shall be final, and waive any right to claim ambiguity in the Contest or these Official Rules. All federal, state, and local laws apply. All federal, state or other tax liabilities arising from this Contest will be the sole responsibility of the prize winners. The Sponsor, its parent companies, affiliates, subsidiaries and advertising and promotion agencies are not responsible for and shall not be liable for: (i) late, lost, delayed, misdirected, incomplete or unintelligible entries, telephone system or computer malfunctions, lost connections or transmission errors; (ii) any injuries, losses or damages of any kind caused by the acceptance, possession, or use of any prize or from participating in the Contest; or (iii) any printing, typographical, administrative or technological errors in any material associated with the Contest. Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend this Contest should a virus, bug, computer problem or other causes beyond the Sponsor’s control corrupt the administration, security or proper play of the Contest. Sponsor may prohibit Entrant from participating in the Contest or winning a prize if, in its sole discretion, Sponsor determines that you are attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other players or Sponsor’s representatives.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION OF SUCH ENTRANT, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
In the event of a dispute, the decision of the Sponsor shall be final and binding.
Acceptance of a prize will constitute permission for the Sponsor to use the names, cities, states, likenesses, and voice recordings of the winners for advertising and promotional purposes, without any further compensation, unless prohibited by law.
7. LIMIT OF LIABILITY AND DISCLAIMERS
A) ALL ENTRANTS AGREE THAT THE SPONSOR, ITS PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, AND AGENCIES AND/OR ANY OTHER PERSON OR ENTITY ASSOCIATED WITH THE CONTEST SHALL NOT BE LIABLE FOR CLAIMS, LOSSES, LIABILITIES, EXPENSES OR INJURIES OF ANY KIND RESULTING IN ANY WAY FROM ENTRANT’S PARTICIPATION IN THE CONTEST, INCLUDING BUT NOT LIMITED TO, THE DRAWING, THE SELECTION, THE USE OF THE PRIZE, ANY DELAYED, LOST, MISDIRECTED, OR DAMAGED ENTRIES, OR ANY COMPUTER, ONLINE SERVICE, COMMUNICATIONS OR OTHER TECHNICAL MALFUNCTIONS THAT MAY OCCUR.
B) ALL ENTRANTS ACKNOWLEDGE THAT THE SPONSOR, ITS PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, AND AGENCIES AND/OR ANY OTHER PERSON OR ENTITY ASSOCIATED WITH THE CONTEST MAKE NO WARRANTY OF ANY NATURE, EXPRESS OR IMPLIED, REGARDING THE PRIZES, WHETHER REGARDING FITNESS FOR PURPOSE, SATISFACTORY QUALITY, DESCRIPTION OR NATURE OF THE PRIZE OR OTHERWISE. ALL ENTRANTS, BY ENTERING THE CONTEST, AGREE TO BE BOUND BY THE ABOVE RULES.
8. DISPUTES/CHOICE OF LAW
Except where prohibited, each Entrant agrees that this Contest shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules. Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of this Contest, including, without limitation, barring Entrants who do not comply with these Official Rules. By entering, Entrants consent to the jurisdiction and venue of the appropriate federal, state and local courts located in New York for any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded.
